Stay on possession proceedings extended

On 5th June 2020, the Ministry of Housing, Communities and Local Government (MHCLG) announced its intention to extend the current suspension on evictions by 2 months (until 23rd August 2020).

This is part of the Government’s commitment to ensure no one is evicted from their home this summer due to Coronavirus.

Following this announcement, Part 55 of the Civil Procedure Rules has been amended to insert a new (temporary) rule which stays possession proceedings until 23rd August.  This stay also applies to all enforcement proceedings by way of writ or warrant for possession.

The new rule, CPR 55.29, comes into force on 25th June when Practice Direction 51Z comes to an end.
